TWO YEARS INTO EFFECT OF THE ORAL SUMMARY COMMERCIAL ACTION: BALANCES AND PERSPECTIVES

Abstract

This article approaches the problems related to the development and implementation of the oral summary commercial trails, the advantages and disadvantages that they come across since it has been approved. The analysis starts with a doctrinal study of the oral summary commercial action, the persons with the faculty to attend this instance, the commercial actions it comprehends, and the specialty that is developed inside the summary actions of this matter. It continues with a description of the reform process to the laws in matters of commerce to adequate into the social reality and allows the development of more agile processes; the development problems that were approached with a gradual system of acceptance of actions of the main source stand out. The study offers principles and stages of the summary commercial action included in the Code of Commerce, it points out some that could be improved to allow for a higher fluidity of the development of processes. Lastly, conclusions are developed on the advantages that have resulted from the summary commercial action when a controversy is settled, as well as some recommendations that improve the results of the summaries in commerce matters.
