Abstract

In this document, the subject of factual argumentation is developed in a way, although it is not new in recent years, it has gained greater strength in the field of the philosophy of law; as one aspect has highlighted is that it has not been addressed clearly by legal theorists, I think that the plus it has is that it has been developed by people who are not limited to theoretical issues. But have set their sights on the field of law practice, in the process, producing in procedural science, with a more modern view on the construction of argument, based on the examination of the statements of the facts and the assessment of evidence. In the factual argument, the hearing is given in the judges or in the people responsible for drawing up a draft resolution to a particular case, not only as a mechanized work, but as a more complete construction, which involves scientific, philosophical work, where it determines what is the truth or reality of the facts of the past and not only be persuaded by the parties, because to that extent, the final result (judgment) is intended to be appropriate fair and effective.
