Reflections on the Positive Characterization Between Forced Internal Displacement and Migration, With a Differential Approach

The object and the possibility of studying it are bonded due to the condition of it to be known and visible. The (forced) internal displacement struggle to be studied, addressed and regulated, mostly because its invisibilitation or, on the contrary, because is visible only by being included in other term: migration. Nevertheless, if these terms are similar, where can be find its difference? Can it be justified the need of distinguish them or they can be included under one same term? This work seeks to answer those questions following two lines of thinking that converge, as everything human, on the law dimension: structural and semantic violence. The objective is to use this work ideas as considerations to evaluate the national legal frame, including the non-yet approved legislative initiative, proposed since 1998.
