Abstract

This article analyzes the legal and social implications of indigenous peoples regarding an effective human right of access to justice. The difficulties of their vulnerability that are aggravated by the marginalization in Mexico are examined, despite the great national and international advances in terms of the recognition of the universality of human rights. The bases in the legal system and the significance of the recognition of the indigenous worldview are studied, as well as the necessary measures for equitable access to justice. The analysis concludes by showing some contributions on the current challenges to determine the scope of an effective human right of access to justice of indigenous communities.
