This essay shows the importance that the General Congress gave to the Federal Constitution of the United Mexican States of 1824, when president Vicente Guerrero was appointed and removed from his charge. This means two moments in which the Constitution functioned, mainly, as an instrumental tool of political factions in the mexican presidentialism, precisely between 1828 and 1830, analysing legal forms about how Guerrero arrived and left the presidency.
