Abstract

As a general rule, human rights have a deep value or interest for the people and, therefore, demanding their enjoyyment and that represents an activity whose exercise is positive; however, there may be exceptions, where the emergence of certain types of rights is from suffering or pain. The text aims to raise as a discussion whether there are human rights whose exercise arises from the undesirable exercise. The debate goes back to the structural problem of the forced disappearance of people suffered in constitutional democracies where violence and crime are the perfect cocktail for manifestations of normalized cruelty that demand the emergence of normative solutions that outline indignation in palliative remedies and resigned activation

Doctor en Derecho por la Universidad Autónoma de Querétaro. Máster en Argumentación Jurídica por la Universidad de Alicante y Máster en Derechos Fundamentales por la Universidad Carlos III de Madrid.
