Abstract

This article addresses the concepts of autonomy and judicial independence of the federative entities in relation to the federation within the constitutional framework of the 1824 Constitution. It highlights the balance of power between the central government and that of the states by granting the latter various competencies and autonomous right. Specific constitutional provisions guaranteeing this autonomy and judicial independence are examined, as well as the challenges and tensions that arose in their application during that historical period in the pursuit of power balance.
