THE REGIME OF GOODS AND OBLIGATIONS ON DRAFT’S PRIVATE INTERNATIONAL LAW DRAFT FOR MEXICO

The text includes the paper presented at the International Seminar "New Civil and Family Procedure Legislation" held in Toluca under the auspices of the Judicial Branch and the Judicial School of the State of Mexico in February 2018. It contains a critical view of both the competition norms judicial system as well as the applicable law regulations contained in the Draft Law on Private International Law for Mexico. In this analysis, the author concludes that it could be substantially improved simply by eliminating or simplifying many of the precepts contained in the Project, although he argues that it is necessary and more difficult to alter its basic conception. Their reasoning and deductions are based on the review and analytical weighting made to the structure of the Bill and its projected provisions on the regime of property (real estate, tangible personal property, incorporeal personal property and securities), as well as to the regime of obligations (contractual and non-contractual obligations) and international jurisdiction and the applicable law in each case.
