Abstract

Through a study of the constitutional bases and the statutory laws of Family Law, this article studies how adoption is regulated in the Mexican legal system. Based on a theoretical approach highlighting the deficiencies of the national adoption system, due to regulatory and criteria differences, a practical study is presented about the adoption cases in recent years. The types of adoption are classified as well as their established role in the legal system. Furthermore, this article explains how these types of adoption are provided in the legislation and the challenges they face. Additionally, the rules established in the national and international law regarding children adoption are studied with a comparative approach, while taking into consideration the particular circumstances of said rules as well as the potential vulnerability situations that may arise during the process. Finally, the conclusions about the regulatory framework are developed and the possible solutions for the international adoption cases are presented.
