RESTORATIVE JUSTICE IN FAMILY MATTERS: ANALYSIS OF THE STATE OF MEXICO JUDICIAL POWER JURISPRUDENCE FROM THE TRANSCOMPLEXITY PERSPECTIVE

Applying the jurisdictional function requires new changes that guarantee the access to justice. For this purpose, there are useful tools such as the postmodern gnoseological currents, including those that form the transcomplexity binomial, whose knowledge basis aims to resolve problems based on their complexity. The jurisprudential criteria for family matters that recognize the restorative justice as applicable in this matter are an example of this new jurisdictional position. This analysis of the State of Mexico Judicial Power jurisprudence from the transcomplexity perspective is based on a descriptive review of the concepts of restorative justice, transdisciplinarity, complex thinking and transcomplexity. Finally, this article concludes with the analysis of the restorative justice formative character as well as its incidence in the development of personal and social life. With this development, a main goal is achieved: the comprehensive restoration of damaged family relationships and, consequently, all the collateral effects that these damaged relationships caused.
